Samsung Sues Apple Over iPhone 5: May Push to Ban Sales

The ongoing battle between the two tech titans Samsung Electronics and Apple Inc. that has had wins and losses on both sides and has spanned four continents continues to escalate. 

The Globe and Mail reported this morning that Samsung Electronics filed court papers today, "accusing Apple Corp.'s iPhone 5 of infringing its patents, as it seeks to regain ground following a $1-billion U.S. court defeat in August." 

The suit alleges the same patent infringements for the iPhone 5 as previous infringement allegations related to the iPhone, iPad and iPod, CNET reported.

The South Korean company said that it "had added Apple's flagship smartphone to the list of devices that allegedly misuse its wireless data technology, according to a complaint filed at a California court in April," The Globe and Mail reported.

Reuters reported that a spokesperson for Samsung said: "...we have little choice but to take the steps necessary to protect our innovations and intellectual property rights." 

The Globe and Mail also added that "a person close to Samsung said that it could not rule out pushing for a sales ban on the new iPhone, although it was not clear when its complaint would be heard in court."

The announcement about Samsung's latest lawsuit came shortly after the same U.S. court lifted a sales ban on Samsung's Galaxy Tab 10.1 tablet device, against which Apple won a preliminary injunction in June, the paper reported.

The court ordered Samsung to pay the aforementioned $1 billion in damages after a California jury found its Galaxy smartphone models had infringed on patents held by Apple. The same court dismissed the claim that the Galaxy Tab 10.1 infringed on iPad design patents.
