DoT seeks opinion on legality of fine imposition on Uninor

The Telecommunications Department had sought a legal opinion before undertaking action on the imposition of an undisclosed fine for possible breach of license conditions of Uninor. The said breach was allegedly committed during its Mumbai operations, according to an internal memo seen by Economic Times.

The note had indicated that the holder of Uninor's license, Unitech Wireless (Mumbai) Pvt Ltd, "was not eligible for grant of unified access service license as provisioning telecom access services was not part of the object clause(s) of the company's Memorandum of Association on the date of application, September 24, 2007."

This license, alongside twenty one others was canceled by the Supreme Court in its 2G case, after the Indian subsidiary of Telenor ASA of Norway had closed shop this February. 

In order to have a legal basis for its action, the DoT had sought opinion of its legal division on its power to impose a fine upon Unitech Wireless (Mumbai), which was originally named as Unitech Infrastructure Pvt Ltd.
