American Airlines and US Airways Group said that waiting until antitrust trial would start in March would cause "significant harm" that would put their proposed merger at risk. Recently, both companies requested the US Department of Justice to set the trial earlier but were not granted.

According to a filing written by the airlines' lawyers, the two companies would stay in limbo for so long before they need to make independent plans. Further, the lawyers wrote to the federal court in Washington that the government's proposed trial had placed the bankrupt American Airlines merger with US Airways in jeopardy.

The two carries had sought for an earlier trial in November. On August 30, Judge Colleen Kollar-Kotelly had scheduled to hear arguments from both sides.

The US Justice Department said that it has not received any settlement proposal regarding the antitrust concerns. The merger of Texas-based American Airlines with US Airways would create the largest carrier in the world.
