Chubby Checker is suing HP over genital-measuring app

On Thursday, San Francisco's US District Judge William Alsup ruled that the musician popular for the dance style called 'Twist' could move forward with his trademark breach claims versus Hewlett Packard Co and its unit Palm.

Ernest Evans, professionally known as Chubby Checker, would sue HP over accusations that the tech corporation utilized his trademarked Chubby Checker name. HP used Chubby Checker on a software application that intends to measure the genitals of a man.

"It was removed in September 2012 and is no longer on any Palm or HP hosted website," Michael Thacker, HP's spokesman, said on Friday. He added the app was not made by HP or Palm. Also, only 88 copies of 'The Chubby Checker' app were sold at 99 US cents each.

HP started offering the app in 2006. It aimed to estimate the dimension of a man's genitals based on the size of his shoes. "The name 'Chubby Checker' is thus used as a vulgar pun," Alsup wrote.
