A day after her son Usher Raymond V was rescued from being caught in a pool drain, estranged wife of singer Usher sought sole custody of the child through court intervention. In her petition, Foster claimed that the father was living in a dangerous environment for the five year old.

Baby Usher nearly drowned in Usher's backyard pool in his home in Atlanta last Monday. This is seen as a precursor to a long and ugly battle for custody as the mother is blaming the father for the accident. At the time of the incident, the Grammy award winning R&B singer was not at home, according to a report.

The incident occurred when Baby Usher sought to retrieve a toy, which was caught in the pool drain. As he went down for the toy, the drain's suction mechanism caught the boy. The boy's aunt, Rena Oden was present, together with a housekeeper and another woman. They tried to pry the boy loose but failed. Only when contractors working at the home came were they able to free Baby Usher, who was then given CPR before being taken to the hospital.

Usher is a multimillionaire who earned his money and fame in the music business. He has parlayed his money into several business ventures, including investments in the NBA's Cleveland Cavaliers, a record label named US records as well as a fragrance line for men and women. He is also one of the founders of the Raymond Braun Media group, which is a record and media company with stars such as Justin Bieber under contract.
