Some TikTok creators claimed the Biden administration's ban violates the First Amendment. Using their argument, they filed a lawsuit against the US government in hopes of overturning the law against the ByteDance-owned social media app.

According to CNBC's latest report, eight TikTok creators filed a lawsuit against the US government. Atty. Davis Wright Tremaine confirmed this, saying that the anti-TikTok law undermines the country's founding principles and free marketplace of ideas.

This is because the legislation forces TikTok to find a buyer for the app within nine months or get completely banned from the United States.

The lawsuit explained that the TikTok ban aims to remove a "discrete medium of communication," which has been a big part of American life. It added that the legislation prohibits petitioners from creating and distributing expressive content with their chosen publisher and editor.

TikTok Owner ByteDance Challenges Biden Admin's Ban

NPR recently reported that ByteDance filed a legal challenge against the Biden administration's introduced law. Lawmakers supporting the ban defended the legislation, saying that the crackdown is needed since TikTok is allegedly linked to the Chinese government.

They stated that this makes the Chinese app a national security threat because China is among the countries hostile against the United States.

However, the law has an issue since lawmakers could not provide direct evidence proving that the Chinese government is attempting to acquire TikTok's user data. They were alson't able to offer any proof that Chinese officials have ever influenced the social media platform.
